GTC General Terms and Conditions of Business Maßsattlerei Hennig Betriebs GmbH Co.KG – Current status: 22.02.2026
§ 1 Scope of application
(1) The following General Terms and Conditions of Business, Delivery and Payment of Sattlerei Hennig – hereinafter referred to as the Contractor – shall apply to all present and future business relations, offers and contracts with its customers – hereinafter also referred to as the Client. Any deviations or verbal ancillary agreements must be made in writing. Individual agreements remain unaffected by this, provided that they have been fixed in writing for both parties. (2) A consumer within the meaning of the following terms and conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his commercial or his independent professional activity. (3) An entrepreneur within the meaning of the following terms and conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity. (4) Customers are hereinafter both consumers and entrepreneurs.
§ 2 Prices / Cancellations
(1) In addition to the contractually owed payment, insurance, packaging and shipping costs shall be charged separately. (2) Cancellations at short notice will be charged as follows: 48h before 100 EUR / 24h before 200 EUR. The amount charged cannot be used for future appointments. The client is – expressly – granted the option of proving lower damages.
§ 3 Offers, placing of orders for visits, conclusion of contracts
(1) The information and offers contained in the price lists, advertisements, Internet pages or other publications of the contractor are non-binding and subject to change. (2) When the client places an order for a visit for the purpose of surveying, the client is scheduled for the next possible visit. A fee of 300.00 € (three hundred euros) is to be paid in advance by the client for the visit, measurement and consultation. Only in the event of conclusion of the contract and execution/performance by the contractor will this amount be credited in full against the final remuneration to be paid. Otherwise, reimbursement is excluded. (3) As a rule, the conclusion of the contract is preceded by a quotation by the contractor after a visit has taken place. The contract is concluded by the contractor’s written confirmation of the order placement by the client.
§ 4 Right of withdrawal for consumers
(1) If the contract is concluded between the contractor and the principal using exclusively means of distance communication and if a special form of distribution within the meaning of § 312b ff. BGB exists, the principal may, if he is a consumer, revoke his contractual declaration in text form (e.g. letter, fax, e-mail) within 14 days without stating reasons. (2) In the event of an effective revocation, the services received by both parties shall be returned. The customer (consumer) shall bear the costs of the return shipment. (3) The right of withdrawal does not apply to contracts for custom-made products tailored to personal needs. (4) Custom-made products, special colours and shapes are not returnable or exchangeable.
§ 5 Advance payment
(1) In the case of a saddle order carried out within Germany, an advance payment of 50% is to be made in advance. (2) For orders outside Germany, the full remuneration is to be paid in advance. (3) The contract is subject to the condition precedent of receipt of payment.
§ 6 Delivery deadlines / Handover
Delivery periods are given to the best of our judgement, but are not binding. Force majeure or serious operational disruptions shall extend the delivery period accordingly.
§ 7 Cancellation of the contract
If the customer withdraws from the contract for reasons for which the contractor is not responsible, the contractor may demand reasonable compensation: up to 1 month: 10% / up to 2 months: 20% / up to 3 months: 30% / up to 4 months: 60% / from the 5th month: 80% of the agreed remuneration.
§ 8–9 Padding / Instructions for use
The first padding within 6 months of delivery is free of charge. Due to changes in the horse’s musculature and weight, the fit of the saddle may need to be adjusted. The saddle should only be used for the horse for which it was fitted.
§ 10 Warranty
Consumers must notify the contractor of obvious defects within 2 months after discovery. Entrepreneurs must inspect goods immediately upon delivery and notify defects within 1 week. The contractor does not assume warranty for normal wear and tear or defects caused by improper handling.
§ 11 Limitations of liability
Liability is limited to material contractual obligations and the direct average damage foreseeable at the time of conclusion of the contract. These limitations do not apply to claims from product liability, warranty, bodily injury, damage to health or loss of life.
§ 12 Limitation of warranty claims
For consumers: warranty period of 2 years for new items. For entrepreneurs: 1 year. For used goods: 1 year for both. The period begins with the handover of the goods.
§ 13–14 Ownership / Rental saddles
The product remains property of the contractor until full payment. Rental saddles are only provided in the event of a binding order for a new saddle. Rental fee: 500 € until end of rental period.
§ 15 Applicable law
The contracts are subject to German law. The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply. Place of jurisdiction: Contractor’s business location.
§ 16–17 Privacy / Severability
We handle your personal data with care. Further information: Privacy Policy. Should individual provisions be invalid, the remaining provisions shall remain in force.
